Baja Amusements and its associates provide their services to you subject to the following conditions. If you visit or shop within this website, you accept these conditions. Please read them carefully.

When you visit Baja Amusements or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

NOTICES

The attractions contained within the Baja Amusements park are of a participatory nature and, as such, carry with them an inherent risk of injury. All guests agree, as a condition of admission, to use these facilities at their own risk.

Baja Amusements is a seasonal business. Hours, tracks, attractions and other offerings available are dependent upon on the weather, available staff and other variable factors. Tracks and attractions listed on the website, in advertising or displayed in any other form of publication may not be open or available for any reason. Tracks and attractions available are subject to change without notice.

The option to purchase a wristband may be discontinued at any time. Wristband gift cards, vouchers and rain checks will be honored regardless of their current availability to purchase. Wristband gift cards, vouchers and rain checks must be redeemed 2 hours prior to the park closing.

Admission items can only be redeemed at a ticket booth in the park; no shipping is available.

REQUIREMENTS

Each track and attraction have requirements that are posted and must be met to be allowed entry. Customers must meet all posted requirements. Both age AND height requirements must be met to drive. Requirements are posted on the website, ticket booths and at each track or ride. Requirements are subject to change without notice.

PRODUCT DESCRIPTIONS

Baja Amusements and its associates attempt to be as accurate as possible. However, Baja Amusements does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Baja Amusements itself is not as described, your sole remedy is to return it in unused condition.

REFUNDS/EXCHANGES

All sales are final. Baja Amusements will not offer refunds, credits, exchanges, rescheduling or returns for any reason. This includes people that are leaving Ocean City, MD and never returning. Tickets are good at any time. Wristband gift cards, vouchers and rain checks are good at any time.

RAIN POLICY / INCLEMENT WEATHER

Baja Amusements is an outdoor facility and operations are subject to the weather. Therefore, tracks and/or rides may be closed due to inclement weather. Refunds will not be given.

Tickets are good at any time. If your race/ride is ended early due to weather, you will receive a replacement ticket. Wristbands will receive a Rain Check for any unused portion of time remaining on the wristband.

TRADE MARKS

Baja Amusements trademarks and trade dress may not be used in connection with any product or service that is not Baja Amusements, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Baja Amusements. All other trademarks not owned by Baja Amusements or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Baja Amusements or its subsidiaries.

YOUR MEMBERSHIP ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. Baja Amusement and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

APPLICABLE LAW

By visiting Baja Amusements, you agree that the laws of the state of Maryland, United States of America without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Baja Amusements or its associates.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Rain Policy and Refund policy, posted on this site. These policies also govern your visit to Baja Amusements. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

PRIVACY POLICY

Baja Amusements respects your privacy and we do not rent, sell, or lease your information to any third party. The details containing your electronic payment are securely transmitted from our payment gateway to our credit card processor for the sole purpose of authorizing your transaction so that we may provide our goods and services to you, the client.

By using the Baja Amusements website, you consent to our use of your information as described in this Privacy Policy. We reserve the right to change our privacy policy at any time without advance notice. Should a new policy go into effect, we will post it on this site, and the revised policy will apply only to information collected thereafter.

Your visit on our site is tracked through a standard web traffic statistics program, which keeps records of traffic on the site. Our server automatically collects data about your server's Internet address when you visit us. When you request pages from our web site, our servers may log your IP Address.
